SCHOOL TERMS & CONDITIONS
SWU is a resource for professional photographers who want to hone their skills and increase their business profitability. By becoming a member of SWU, you agree to be bound by the following terms & conditions of use.
SWU reserves the right to amend these terms at any time. Member will be notified by email of material changes to these terms.
Member's account may be terminated without notice at any time for failure to abide by any of these Terms.
MEMBERSHIP
Membership is limited to individuals over the age of 18.
Membership is not transferable.
Members are responsible for keeping their password secure and may not use another member's account.
Member must use either their real name or legal business name on their profile. Anonymous memberships are not allowed.
Members must maintain a website, blog or other web presence as proof that they are in the business of photography.
SWU reserves the right to accept or reject membership at its sole discretion.
By joining SWU, members acknowledge that SWU is a subscription-only service.
Members may terminate their membership at any time.
Member is responsible for all of the content he or she uploads, shares or copies with SWU.
Members may not use the services provided by SWU for unlawful or prohibited purposes such as:
- Content that is patently offensive, or that promotes racism, bigotry, hatred or physical harm of any kind against any group, individual.
Content that attacks, harasses or advocates harassment of another person.
Content that involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing or "spamming."
Content that promotes information that is false or misleading, or that promotes illegal activities
Content that promotes the illegal or unauthorized copying of another person's copyrighted work, for example, providing pirated computer programs or links to such programs, providing information to circumvent manufacturer-installed copy-protect devices, or providing pirated music or links to pirated music files.
Content that contains restricted or password-only access pages or hidden pages or images not linked to or from another accessible page.- Content that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18.
Content that depicts pornography of any sort.
Content that provides instructional information about illegal activities such as making or buying illegal weapons, violating the privacy of another, or providing or creating computer viruses;
Content that solicits passwords or personal identifying information for commercial or unlawful purposes from other members.
Content that involves commercial activities and/or sales without the prior express written consent of Sam's World University. This prohibition includes, but is not limited to, contests, sweepstakes, barter, advertising, or pyramid schemes.
Content or conduct that is abusive, threatening, obscene, defamatory, or libelous.
Member must not transmit any virus, code, worm, data or any other file of a destructive nature.
If members violate these terms or otherwise disrupts the SWU site, the member is subject to detention, suspension or expulsion from SWU without prior notice and without refund. Notice of expulsion from SWU will be sent to email address provided by the member at registration.
SERVICES
SWU strives to maintain web presence 24 hours a day, however SWU may occasionally be interrupted for upgrades or disrupted for unforeseen technical difficulties. SWU will not be liable for any disruption of the service for any reason.
By submitting images or sharing articles and testimonials with SWU, members grant SWU a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform such submissions in connection with the SWU Website and SWU business, including without limitation for promoting and redistributing part or all of the SWU Website (and derivative works thereof) in any media formats and through any media channels. Member understands and agrees that SWU may retain server copies of submissions that have been removed or deleted.
Member hereby grants each user of SWU a perpetual, irrevocable, and non-exclusive license to access member's submissions through the SWU website, and to use, reproduce, distribute, display and perform such submissions.
PRIVACY POLICY
SWU is committed to safeguarding member's privacy.
Member phone personal information are not posted online, and are only retained by SWU for contact purposes.
OTHER LEGAL MATTERS
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado. Any dispute between Member and SWU shall be adjudicated in courts within the state of Colorado.
All trademark brands and service names used in this service which identify SWU are proprietary marks of SWU.
SWU may provide external links to other websites, but SWU does not endorse or assume responsibility for the content or availability of any other website.
Member agrees to indemnify and hold SWU, its subsidiaries, affiliates, officers, agents, partners and employees harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to, or arising out of, member's use of the SWU service in violation of these terms.
FEES
The right of access granted under these terms is effective only upon payment of the subscription fees, which are non-refundable, other than as expressly provided herein.
The monthly subscription automatically renews for a fee of $24.99 per month.
SWU will charge the subscription fees to member's credit card, every calendar month unless member cancels the subscription as set forth herein. The Per Calendar Month subscription shall renew automatically each month, and SWU will charge the monthly subscription fees, on the first each corresponding month. If a particular month does not include the date, SWU will charge the monthly subscription fees on the first of that month.
The monthly subscription may be canceled by member by notifying SWU in an e-mail sent to admin@samsworlduniversity.com, but any fees paid are non refundable.
SWU may increase subscription fees at any time and for any reason, and such increased fees shall be applicable to any new subscription or re-subscription.
REFUND POLICY
The SWU monthly educational service (access to all the information on the website, with options to download/purchase additional materials) is not refundable after payment has been made. CDs and DVDs may be returned for a full refund if they have not been opened and are in the original packing.
RETURN POLICY
If a CD or DVD is not working, customers may call customer service for tech support or authorization to return the product for a functioning disc.
CANCELLATION POLICY
The SWU service may be cancelled in advance of the next month's edition if a subscriber arranges to cancel automatic withdrawal from the credit card number on file with SWU. Once payment has been received, cancellation is not allowed.
DELIVERY POLICY/SHIPPING POLICY
CDs and DVDs will be shipped via USPS within 14 business days of receipt of payment.
